SHIPPED SEMEN CONTRACT, BREEDING SEASON 2008

This TRANSPORTED SEMEN BREEDING CONTRACT for the breeding season 2008, is made and enter into on this ___day of_____, 2008, is by and between Scenic View Paints, hereinafter designated BREEDER, and___________________hereinafter designated MARE OWNER. Mare owner agrees to breed the mare_________________BREED_________________ REG#_______________to the stallion SCOTCHA IMPERIAL REG#356-251.

1. All fees must be paid prior to shipping. Breeding fees and shipped semen fees. (Out of state checks need 10 days to clear before shipping)

2. Breeding season is February 15th to May 15th 2008. Shipped semen charges: FIRST SEMEN SHIPMENT FREE. Additional shipment $150 Next day, includes next day service (UPS or FedEx), and the use of Equitainer or disposable container. Each shipped contains (2) insemination dosages If possible. If shipping outside the USA please call for shipping fees.

3. If semen is shipped via an Equitainer, the Equitainer must be returned in usable condition within 72 hours. If Equitainer is not returned within 96 hours, a $10/day rental fee will be charged until the Equitainer is returned. Failure to return the Equitainer within 7 days or if the Equitainer is damaged, the mare owner will be charged $300 for the Equitainer. Disposable containers MUST be returned also in the same time frame as the Equitainer.

4. You must notify the BREEDER of the expected breeding date at least two weeks prior to actual shipping date. You MUST REQUEST A SHIPMENT 24 HOURS PRIOR to the shipping time.

5. Breeder agrees to diligently try to settle the mare, however, if mare fail to settle, for any reason, Mare Owner will hold Scenic View Paints blameless.

6. It is further agreed that should the stallion die or become unfit for service prior to fulfilling this contract, that 1/2 of the stud fee will be refunded, only the stud fee. If the mare should die or become unfit to breed prior to fulfilling this contract, the mare owner may substitute another mare, no Tobiano or Tovero mares unless agreed upon by Scenic View Paints.

7. The mare shall be in healthy and sound breeding condition. A copy of the registration papers, veterinarian's health certificate, must accompany the breeding fee.

8. A "BREEDER CERTIFICATE" will be issued for the foal, conceived by this mating, when stallion fee and all other expenses have been paid in full and when the mare has produced a live foal from this mating. Mare owner must send a photo of resulting foal with mare.

When Mare Owner and Breeder sign this contract, it will be binding on both parties, subject to the above terms and conditions.
