RR 2, Box 28 STALLION CONTRACT, BREEDING SEASON 2008
This STALLION BREEDING CONTRACT for the breeding season of 2008, February 15th to May 15th 2008 and is made and entered into on this ____ day of __________, 2008 is by and between Scenic View Paints , hereinafter designated Breeder and ___________________________, hereinafter designated Mare Owner. Mare Owner agrees to breed the mare Reg. No. ________________ To the stallion Scotcha Imperial, Reg No #356-251 for the fee of $_______, for a live foal, subject to the following conditions.
1. All Tobiano & Tovero Mares are private Treaty, NO EXCEPTIONS.
2. Breeder agrees to provide suitable facilities for the care and feed of the mare and/or foal while in their custody. Mare Owner agrees to pay for care and feed at the rate of $______ per day for wet mares and $______ per day for dry mares.
3. Breeder will exercise judgment consistent with recognized standards in care and supervision of mare and/or foal. Breeder assumes responsibility for arranging veterinarian services as necessary. Breeder's veterinarian will examine mare for normal breeding conditions and administer medical care as deemed necessary for the health and safety of the mare and/or foal. All veterinarian expenses will be paid by Mare Owner, _________________________.
4. Mares that are not halter broken will not be accepted.
5. The mare shall be in a healthy and sound breeding condition, free from infectious, contagious or transmissible disease. A current negative Coggins Test, photocopy of registration papers (both sides), veterinarian's health certificate, plus a health, worming and immunization record must accompany mare; if they do not, Breeder's veterinarian will examine and/or test mare at Mare Owner's expense. Breeder reserves the right to refuse mare if not in satisfactory condition.
6. Breeder agrees to diligently try and settle mare; however, if mare fails to settle, for any reason, Mare Owner will hold Breeder blameless. Mare Owner agrees to give Breeder ample opportunity to settle mare.
7. Contract contains a "Live Foal Guarantee". A live foal is described as a newborn foal which stands and nurses without assistance. If foal is born dead, return privileges for the 2008 season only if Breeder is notified within 5 days and receives a veterinarian's statement confirming death. Being pronounced "safe in foal", the mare should miscarry, abort or prove barren after leaving the Breeder's premises. Mare Owner has the privilege to return for breeding during the current breeding season February 15th through June 15th. Or the following year, 2008.
8. A "Breeder's Certificate" will be issued for the foal, conceived by this mating, when the stallion fee and all other expenses have been paid in full; when the mare has produced a live foal by this mating & when a photo of the resulting offspring is sent to Scenic View Paints.
9. Both parties agree that Scenic View Paints (farm), the Breeder, their agents or employees are not liable for death, sickness and/or accident including consequential damages caused to the mare and/or foal unless such death, sickness and/or accident was by the willful and wanton negligence of the Breeder; and the Mare Owner is not liable for death, sickness, and/or accident including consequential damages caused to the stallion.
10. It is further agreed that should the stallion die, be sold by the owner, or become unfit for service prior to settling the mare, that 1/2 of the breeding fee will be refunded, if it has been paid in full, thereby canceling this entire contract; or, if mare dies or becomes unfit to breed before being pronounced in foal, the Breeder may substitute another mare according to paragraphs 1, 4 and 5 as a replacement.
11. This Contract is entered into the in the State of IL, and will be interpreted and enforced under the laws of that state. If any clause in this Contract is against State law, then that clause shall be null and void.
12. If a foal is born and it is agreed that it is a breeding stock, by both Scenic View Paints and the APHA then Scenic View Paints has the right to have the foal blood typed to make sure this foal is an offspring of Scotcha Imperial's. All blood typing and vet fees will be paid by Scenic View Paints, (only the blood typing and vet fees that pertains to line 12) If offspring is NOT Scotcha Imperial's, mare owners will be liable for blood typing and vet bills.
Scenic View Paints will guarantee a color foal that can be registered with the APHA regular registry. If it can only be registered as a breeding stock foal, then Scenic View Paints will refund the stud fee back to the mare owner's. Only the STUD FEE will be refunded. NO STUD FEE WILL BE REFUNDED if for any reason the mare aborts or the mare dies, the mare owner has the right to substitute another mare. Mare owner is responsible for mare care and any veterinarian expenses.
